Welcome to Foku. By downloading, installing, or using the Foku mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By accessing or using Foku, you confirm that you are at least 13 years of age (or the minimum age required in your jurisdiction) and that you agree to comply with these Terms and all applicable laws and regulations.

2. Description of Service

Foku is a focus and study companion app that uses your device's camera to detect distractions and help you stay focused. The App includes features such as lo-fi music playback, study session tracking, Pomodoro timers, and break-time activities.

3. User Accounts

You may use Foku as a guest or create an account. If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

4. Subscriptions and Payments

• Subscription Options: Foku Plus is available as a monthly or annual subscription.
• Billing: Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
• Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Management: You can manage or cancel your subscription in your device's account settings (App Store or Google Play).
• Free Trial: If offered, any unused portion of a free trial period will be forfeited when you purchase a subscription.

5. Free Tier

Foku offers a free tier with a daily usage limit. Authenticated users receive up to 60 minutes per day, and guest users receive up to 30 minutes per day. These limits may change at our discretion.

6. Camera Usage

Foku requests access to your device's camera solely for the purpose of distraction detection during study sessions. All camera data is processed on-device and is never uploaded, stored, or shared. You can revoke camera permission at any time through your device settings.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Interfere with or disrupt the App's functionality
• Use the App to harass, abuse, or harm others
• Circumvent any usage limits or access controls

8. Intellectual Property

All content, features, and functionality of Foku (including but not limited to text, graphics, logos, audio, and software) are owned by Foku and are protected by copyright, trademark, and other intellectual property laws.

9. Disclaimer of Warranties

Foku is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

To the fullest extent permitted by law, Foku and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

11. Termination

We may suspend or terminate your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or the App.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the updated Terms in the App or on our website. Your continued use of the App after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
